Data Processing

Personal data means any information relating to an identified or identifiable natural person, such as your name or email address. ‘Processing of data’ means, in particular, the collection, storage, use and transmission of your data.

Where we obtain the data subject’s consent for personal data processing operations, Art. 6(1), first sentence, lit. a GDPR serves as the legal basis.

Where the processing of personal data is necessary for the performance of a contract to which the data subject is party, Art. 6(1), first sentence, lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary in order to take steps prior to entering into a contract.

Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Art. 6(1), first sentence, lit. c GDPR serves as the legal basis.

Where vital interests of the data subject or of another natural person make the processing of personal data necessary, Art. 6(1), first sentence, lit. d GDPR serves as the legal basis.

Where processing is necessary for the purposes of a legitimate interest pursued by our company or by a third party and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6(1), first sentence, lit. f GDPR serves as the legal basis for the processing.

The personal data of data subjects will be erased or blocked as soon as the purpose of storage no longer applies. Storage after the purpose of storage has ceased to apply may take place if this is provided for by law. The data will also be blocked or erased when a storage period prescribed by the aforementioned provisions expires, unless continued storage of the data is necessary for the conclusion or performance of a contract.

Further information on the legal bases for processing and the storage period for specific personal data can be found in the respective subsection.

1. Rights of the Data Subject

The Rights in Detail

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller (where applicable, subject to any further requirements stipulated in the relevant provisions):

  • Right of access (Art. 15 GDPR),
  • Right to rectification and erasure (Arts. 16, 17 GDPR),
  • Right to restriction of processing (Art. 18 GDPR),
  • Right to withdraw consent if you have consented to the processing,
  • Right to data portability (Art. 20 GDPR)

Right to Object

Where, as explained above, we process personal data in order to safeguard our legitimate interests that prevail in the context of a balancing of interests, you may object to this processing with effect for the future, but only on grounds relating to your particular situation (Art. 21 GDPR). If processing is carried out for direct marketing purposes, you may exercise this right at any time without stating any grounds. After you have legitimately exercised your right to object, we will no longer process your personal data for these purposes, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or where the processing serves the establishment, exercise or defence of legal claims. This restriction does not apply where the processing is carried out for direct marketing purposes.

Complaint

If you believe that we are not respecting your rights to the required extent, you have the right to lodge a complaint with a data protection supervisory authority concerning our processing of your personal data. Before doing so, however, we would appreciate it if you informed us of your concerns first so that we can remedy the reason for the complaint ourselves.
